Seat belt defense, i.e. arguing that not wearing the seat belt had a contribution to the hurts, is a controversial issue in injury code. Some states allow it and hence the compensation paid to the injured not wearing the seat belt may be reduced (or barred), others consider it in some form, and yet the majority disregard it altogether, that is, it is not admissible.
