There are, as with most legal concepts, varying definitions of “agency” and “agent”. One definition is that an agent is a person who has the authority of another (the principal) to constitute legal relations between the principal and a third party. Any legal relationship will then depend on the authority the agent has and the action by the agent pursuant to that authority.
